Meta ordered to pay $25 billion in civil penalties in New Mexico Cambridge Analytica case
A judge cut the award from $219.5 billion to $25 billion after a September jury finding. Meta says it will appeal. A separate 2022 class action settled for $725 million.

A New Mexico judge ordered Meta on October 21 to pay $25 billion in civil penalties after a jury found the company misled state consumers about data protection. The case stems from the Cambridge Analytica scandal, in which the firm allegedly accessed information on 87 million users improperly. Meta says it will appeal.
The headline number says more about New Mexico's penalty formula than about new wrongdoing: 43 million counted violations at $5,000 each produced a $219.5 billion figure that no court was likely to leave standing. Meta's appeal will probably shrink the $25 billion further, as the earlier Cambridge Analytica class action settled for $725 million. What matters for other platforms is the template: state consumer laws with per-violation penalties can turn a decade-old scandal into a balance-sheet risk long after the conduct stopped.

How the penalty was calculated
The jury found in September that Meta misled New Mexico consumers about its data protections and its handling of harmful content, according to CNBC and The Verge. It counted more than 43 million violations of the state's unfair practices law, each carrying a maximum civil penalty of $5,000. Multiplying the two figures gives more than $215 billion, our arithmetic, which is consistent with the $219.5 billion unreduced award CNBC reports, though the court's own calculation was not read. The judge lowered the amount to $25 billion.

Why a 2018 data scandal is in a New Mexico court
Cambridge Analytica was the firm at the center of the 2018 scandal, in which it allegedly accessed information on 87 million Facebook users improperly, CNBC says. New Mexico's lawsuit was filed in 2021 under the state's unfair practices law, which allows a civil penalty for each violation. CNBC identifies the judge as Francis Mathew and says he found that Meta's Facebook failed to conduct the comprehensive investigation it promised after the revelations. The same report says the penalty accrues interest at 15% a year until paid.
The Verge attributes to the attorney general's office a description of the award as one of the largest corporate financial penalties in U.S. history.
Earlier settlements
Meta agreed in 2022 to pay $725 million to settle a separate class action tied to Cambridge Analytica, CNBC says. By our arithmetic, $25 billion is roughly 34 times that sum. The two are different proceedings, so the comparison shows scale only.
New Mexico did not join an August settlement that resolved other privacy lawsuits derived from the scandal, which let its case go to trial, according to CNBC.
Who is affected
The State of New Mexico is the named recipient of the payment, per TechCrunch. New Mexico consumers are the group the jury found were misled.
Meta's response
Meta says it will appeal, according to TechCrunch and GSMArena. Chief legal officer C.J. Mahoney argues the lawsuit seeks to tax speech and impose new rules on online expression, per CNBC and The Verge.
